Right to portability

  2. b) Transmit this data to another controller.

The data subject has the right, at any time, to object to the processing of his data, for reasons related to his particular situation.

Right to limitation of treatment

The data subject has the right to ask K-Masion to limit the processing of their personal data when certain situations occur, such as:

Right to erasure (or to “be forgotten”)

The holders of personal data may request that their data be completely erased, without undue delay and, in this sense, K-Masion must erase them.

This right can only be granted to the holder in the following situations:

  • The holder of personal data has withdrawn the consent on which the processing of personal data is based, and there is no other legal basis that justifies the processing of the same;
  • The holder exercises the right to oppose the processing of his personal data, for reasons related to his particular situation, when the basis of lawfulness is the legitimate interest of the company, provided that there are no other compelling and prevailing legitimate reasons;
  • The holder exercises the right of opposition to the processing, when personal data are processed for the purposes of direct marketing;

  • When the retention period defined for the data has been exceeded.

However, K-Masion shall not defer deletion when treatment proves to be necessary:

  • Compliance with a legal obligation that requires treatment provided for by the law of the European Union or of a Member State to which K-Masion is subject;
  • The exercise of public interest functions or the exercise of public authority vested in the person responsible for the processing of personal data;
